1. About these terms

These terms apply to gemlumo.com and purchases made from Gemlumo. By using the website or submitting an order, you agree to these terms together with our Privacy Policy, Shipping Policy and Returns Policy. If you do not agree, do not use the website or place an order.

You must be at least 18 years old, or have permission and supervision from a parent or legal guardian, to place an order.

2. Product information and handmade variation

We aim to describe product materials, dimensions, framing, condition, colour and availability accurately. Screen settings, lighting and photography can affect how colours appear. Handmade and hand-finished pieces may have small variations that form part of their character and are not faults. This does not affect rights relating to products that are faulty, unsafe, materially different from their description or otherwise fail a consumer guarantee.

3. Prices and charges

Prices are shown in the currency displayed on the website. Applicable product taxes are included where stated. Delivery charges and available services are shown before payment. For international orders, the recipient is responsible for import duties, taxes and local handling charges unless checkout expressly states they are included.

4. Orders and acceptance

Submitting an order is an offer to buy the selected products. We acknowledge receipt electronically, but an order is accepted when we confirm dispatch or otherwise expressly accept it. Before acceptance, we may decline or cancel an order for a legitimate reason such as unavailable stock, an obvious pricing or description error, suspected fraud, delivery restrictions or inability to obtain payment authorisation. If we cancel after taking payment, we will promptly refund the affected amount to the original payment method.

Please check your contact, delivery and order details before submitting payment and contact us promptly if anything is incorrect.

5. Payment

You authorise Gemlumo and the payment provider selected at checkout, such as Stripe or PayPal, to charge the total displayed before confirmation. Payment-provider terms may also apply. We do not store complete payment-card numbers. Ownership of physical products passes when payment is complete and the product is delivered, subject to applicable law.

6. Availability and one-of-a-kind pieces

Products may be one of a kind or available in limited quantities. Placing an item in a cart does not reserve it. If simultaneous orders or an inventory error make a paid item unavailable, we will contact you and provide an appropriate substitute option where agreed or a full refund.

7. Shipping and delivery

We ship to destinations supported at checkout. Dispatch and delivery periods are estimates unless expressly guaranteed. Delays can occur because of carriers, customs, weather, remote locations or events outside reasonable control. We will provide required information and reasonable assistance if a delivery is delayed or lost. Full details are in our Shipping Policy.

8. Returns, refunds and consumer guarantees

Our voluntary change-of-mind policy, return process and refund timing are set out in the Returns Policy. Proof of purchase may be required. Those additional benefits do not replace your legal rights.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they are not of acceptable quality and the failure is not a major failure.

9. Digital gift cards

Paid Gemlumo gift cards are delivered electronically and may be redeemed only through Gemlumo for eligible products. They are not reloadable, cannot be exchanged for cash except where required by law, and must not be resold or used unlawfully. Gift cards supplied in Australia are valid for at least three years from the date of supply unless the law requires a longer period or a stated exception applies. Any expiry date and material restrictions will be shown with the gift card. Keep the code secure; contact us promptly if it is lost, stolen or used without permission.

10. Accounts and security

You are responsible for providing accurate account information, protecting your password and notifying us of suspected unauthorised access. You are responsible for activity conducted through your account unless caused by our failure to take reasonable care. We may suspend access where reasonably necessary to protect you, other customers or the website, investigate misuse or comply with law.

11. Reviews, comments and other submissions

You retain ownership of content you submit. You give Gemlumo a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for operating and promoting Gemlumo, subject to our Privacy Policy. Do not submit content that is unlawful, misleading, infringing, abusive, malicious or contains another person’s private information. We may moderate or remove content reasonably believed to breach these terms.

12. Acceptable website use

You must not interfere with the website, bypass security or access controls, scrape or copy content at unreasonable volume, introduce malicious code, misuse another person’s account, make fraudulent purchases, or use the website in violation of law or another person’s rights.

13. Intellectual property

The Gemlumo name, logos, website design, text, original photography, graphics and other store content are owned by or licensed to Gemlumo and protected by intellectual-property laws. You may access the website for personal, non-commercial shopping use. No other use, reproduction, adaptation or distribution is permitted without prior written permission or a legal exception.

14. Third-party services and links

The website may use or link to third-party payment, delivery, social or other services. We are not responsible for independent third-party websites or services outside our control, but this clause does not exclude responsibility that the law places on Gemlumo.

15. Liability

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded. To the maximum extent permitted by law, neither party is liable to the other for loss that was not reasonably foreseeable when the relevant contract was formed. You are responsible for following product care, installation and hanging instructions and using suitable wall fixings. This clause does not limit liability for fraud, wilful misconduct, personal injury caused by negligence, or any liability that cannot legally be limited.

16. Events outside reasonable control

Neither party is responsible for delay or failure caused by events outside its reasonable control, but this does not remove obligations to communicate, provide services within a reasonable time or offer remedies required by law.

17. Changes to these terms

We may update these terms prospectively by publishing a revised version and date. The terms applying to an accepted order are those in effect when the order was placed unless a change is required by law or you agree otherwise.

18. General

If a provision is unlawful or unenforceable, it is read down or severed to the minimum extent necessary without affecting the remaining provisions. A delay in enforcing a right is not a waiver. These terms are governed by the laws of New South Wales, Australia, and the parties submit to its courts, without limiting any right a consumer has to bring a claim in another jurisdiction under applicable law.
